Terms & Conditions of Entry

1. 1. Promoter:

The Promoter is Efkar Pty Ltd (ACN: 074 448 374) and Pontians Pty Limited (ACN: 074 434 183) of PO Box 4317, Manuka ACT 2603.  The Competition is authorised by ACT Permit #: ACT TP 10/01882.1

1. 2. Eligibility:

To be eligible to enter the competition the contestant must:

 

1. be over the age of 18 years old;

 

1. be the owner of a motor vehicle that is registered in the Australian Capital Territory (“the ACT”);

 

1. have a present and continuing liability to pay mortgage or rental instalments in respect of the contestant’s home residence for the 12 months extending from the date that the competition closes; and

 

1. have paid for one or more products or services to the combined value of $30.00 from a  participating store located in the Belconnen Fresh Food Markets during the period in which the competition is open and obtained a proof of purchase from the store (“a Valid Receipt”). Participating stores are: Wiffens Premium Green Grocers, The Chicken Coop, Fishco Downunder, Li’s Hotbake, Bunches@Belconnen, Ziggy’s Garden Fresh, Tom’s Superfuits, Fins Seafood Café, Market Meats at Belconnen, Deli Cravings, Mikes Meats,  Knead Patisserie, Natural Living, Tee’s Trading House, Ben’s All Meats, Market Gourmet, Belconnen Deli, Janey Fashion, Mun2 Gourmet, Chona Smith, Book Passion, Food Lovers, Beppe’s Tuscan Kitchen, Cooking Co-Ordinates, As Nature Intended, Eco Meats, Petbarn, and First Choice Liquor.

1. 3. How to enter:

3.1.       Contestants are to write their name, address and telephone number on a Valid Receipt and deposit it in one of the competition boxes provided by the Promoter before the time for the closure of the Competition as set out in section 4 herein.  Any entry that does not have the contestant’s contact details will be considered invalid.

 

3.2.       The Promoter reserves the right to verify the validity of entries. The Promoter reserves the right to disqualify any contestant for tampering with the entry process or for submitting an entry that is not valid and in accordance with these Terms and Conditions of Entry.

1. 4. Timing:

The Competition runs from 12:00:01 am GMT on 24 May 2010.  The Competition closes at 7:00:00 pm GMT on 17 July 2010.  Entries must be received by the Promoter no later than the closing date and time.

1. 5. Selection of winners:

Competition winners will be drawn at random out of a barrel at Belconnen Fresh Food Markets at 1 Lathlain Street, Belconnen ACT at 1:00 pm GMT on 24 July 2010.  The major prize winner will be the contestant whose Valid Receipt is drawn first and who satisfies the eligibility requirements set out in paragraph 2, 8.2 and 8.4 of these Terms and Conditions of Entry.  The winner of the minor prize will be drawn after, and in the same manner as, the winner of the major prize.

1. 6. Notification of winners:

 

Winners are not required to attend the draw.  Winners will be notified using the contact details they provided on the entry form.   The Prize winners will be named in the Canberra Times newspaper within 14 days of the draw.  No other attempts will be made by the Promoter to locate or contact the winners.

1. 7. Redraw:

 

7.1.      If the drawn winner is not able to be contacted and/or be available to collect the prize and/or   execute the Deed by 1:00:01 pm GMT on 17 October 2010 all rights that the person may have had to the prize will be forfeited.

 

7.2.      In the event that there are unclaimed prizes, a redraw will take place at 1:00 pm GMT on           24 October 2010 at the same location and in the same manner as the first draw.

 

1. 8. Major Prize:

8.1.      The major prize consists of each of the following:

 

1. The motor vehicle component;

 

(i)   Usage rights for a personalised number Plate with the word “BFFM“ (or other such available word that the Promoter shall decide in its absolute discretion) (“the Plates”) for a period of 12 months.

 

The Promoter will pay the applicable ACT Government fee for issuing the Plates.  Should the Promoter elect to exercise its option to acquire the usage rights to the Plates at the expiration of the 12 month period, the Promoter will pay the applicable ACT Government transfer fee and the fee to issue standard replacement number Plates (excluding vehicle registration charges).

 

This prize cannot be taken as cash.

 

(ii)   A cheque made payable to the winner in the amount that is equivalent to the  ACT Government fee for registering the winner’s motor vehicle in the ACT for a period of 12 months (excluding stamp duty, inspection fees, insurance other than CTP insurance, or any other fees or charges).  Any concession entitlements of the winner will be taken into account in calculating the payment.  The maximum amount that will be paid is the cost of registering a private passenger vehicle of the maximum weight category;

 

1. The home mortgage or rental component;

 

The Promoter will contribute up to a maximum of $12,000 towards the major prize winner’s residential home mortgage or rental.  This will be paid by way of 12 monthly instalments of up to $1,000 paid on the winner’s behalf directly into the bank account that he or she is required to make regular mortgage or rental payments in respect of his or her home residence. The Promoter will not be liable to pay any amount exceeding the lesser of $12,000 or the winner’s actual mortgage or rental liability assessed as at the date the competition is drawn.  If the winner’s liability to pay mortgage or rental in respect of his or her home is reduced or absolved during the 12 month period, then the Promoter will only pay monthly instalments equivalent to the reduced amount (if any)

 

This prize cannot be taken as cash; and

 

1. The groceries component

 

The major prize winner will also receive a total of $3,000 worth of Belconnen Fresh Food Markets Vouchers.  The vouchers are redeemable at participating Belconnen Fresh Food Market stores.  The vouchers will expire after 12 months from issue.

 

This prize cannot be taken as cash.

 

The total value of the major prize is to a maximum of $18,632.40. No responsibility is taken for any variation in the value of any of the prizes.

 

8.2.      In order to be eligible to receive the major prize (or any part thereof) the winner must:

 

1. disclose to the Promoter all prior driving related infringements and convictions; and

 

1. disclose to the Promoter evidence that the winner is presently liable to pay mortgage or rental payments in respect of the winner’s home residence and proof of the maximum amount that the winner will be liable to pay in respect of that mortgage or rental in the 12 month period following the close of the competition.

 

8.3.      The Promoter may decide in its absolute discretion that the winner is ineligible to receive the major prize (or any part thereof) because, in the Promoter’s opinion:

 

1. the nature or frequency of the infringement(s) or conviction(s) would indicate that there is a risk that the winner may not comply with the road rules during the 12 month period or may otherwise operate the motor vehicle in a way that could bring the Promoter or the Belconnen Fresh Food Markets into disrepute; or

 

1. the winner has failed to provide sufficient evidence that the winner is liable to pay mortgage or rental payments in respect of the winner’s home residence or failed to provide proof of the amount that the winner is liable to pay in the 12 month period.

 

8.4.      In order to be eligible to receive the major prize (or any part thereof) the winner must duly execute a deed in the form provided by the Promoter in which the winner agrees to:

 

1. Promptly take all steps necessary to enable the Promoter to arrange for the Plates to be issued for the winner’s motor vehicle;

 

1. Confer upon the Promoter the exclusive option to acquire the Plates at no cost (other than the associated ACT Government fees) after the 12 month period;

 

1. Ensure that the Plates are affixed to the relevant vehicle to which the Plates have been registered at all times;

 

1. Not sell, transfer, or otherwise dispose of the Plates or the rights to use the Plates other than as directed by the Promoter;

 

1. Notify the Promoter of any change in circumstances that could prejudice the Promoter’s ability to exercise its option to acquire the Plates after the 12 month period;

 

1. Comply with the road rules and ensure that any person driving the winner’s motor vehicle also comply with the road rules;

2. Refrain from operating the motor vehicle (or allowing it to be operated) in such a way that there is a risk that the Promoter or the Belconnen Fresh Food Markets could be brought into disrepute;

3. Notify the Promoter of any traffic infringement notices, road rule convictions or incidents involving the vehicle being operated in such a way that could bring the Markets into disrepute;

 

1. Promptly take all steps necessary at the expiration of the 12 month period to return the Plates to the Promoter and to transfer the usage rights in the Plates (at no charge to the Promoter) to the Promoter or to such other person that the Promoter may nominate; and

 

1. In the event that the winner defaults on any one of the agreed terms, the winner agrees to return the Plates, forgo any entitlement to future mortgage or rental contributions from the Promoter and repay in full the cash prize portion of the Motor Vehicle component received from the Promoter.

 

 

1. 9. Minor Prize:

 

9.1.      The minor prize winner will receive a total of $2,000 worth of Belconnen Fresh Food Markets Vouchers.  The vouchers are redeemable only at participating stores.  The vouchers will expire after 12 months from issue.

 

9.2.      The total value of the minor prize is $2,000.

 

9.3.      This prize cannot be taken as cash.

 

10. Prizes are not transferable or exchangeable

 

Except with the written consent of the Promoter all prizes are not transferable or exchangeable and cannot be taken as cash.  The Promoter has absolute discretion as to whether it will provide such consent and need not provide any reason for its decision.

 

11. Indemnity:

 

All contestants release and indemnify the Promoter, its agents employees and associated companies against all liability, actions, claims, suits, damage, demands, cost, loss or expense arising out of acceptance of any prize or participation in the competition including (but not limited to) loss of income, personal injury and damaged property and whether direct or consequential, foreseeable, or due to some negligent act or omission or otherwise.

 

12. Reservation of rights

 

12.1.   The Promoter reserves the right to amend, modify, cancel or withdraw the competition at any time and without notice.  The Promoter’s decision in respect of any aspect of the Competition is final. No correspondence or discussion will be entertained.  No responsibility is accepted for late, lost or misdirected entries.

 

12.2.   All entries become the sole property of the Promoter.

 

13. Personal Information:

 

13.1.   The Promoter will collect each contestant’s personal information in order to conduct the promotion and notify winners and such information will not be used for any marketing or similar purpose otherwise than in accordance with section 13.2 below.

 

13.2.   The Promoter reserves the right to publish the named characters, likeness or voices of any contestants or winners for any promotion or matters incidental to the Competition.
